Terms and conditions

Online General Sales Conditions

The supply and sale of products on the website www.incascaffe.it and the Customer Service number 082424226 are regulated by the following General Sales Conditions. The General Sales Conditions are formulated in accordance with the regulations regarding contract agreements entered into outside of the business premises and particularly according to dal Lgs. D. 6 September 2005, no. 206 (Consumer Code)

Definitions:

1.1   With the expression “on-line sales contract” reference is made to the sales contract agreement related to the Supplier’s material tangible assets

1.2   With the expression “Buyer” reference is made to the person who acts for purposes that are not connected to his own business/professional activity, identified via the website www.incasscaffè.it or via phone call, who has placed an order accepted by Incas Caffè srl.

1.3    With the expression “Supplier”, reference is made to Incas Caffè srl, with offices  in 82100 Benevento, at Pezzapiana Industrial Area, entered in the Business Registry of the Chamber of Commerce of Benevento, Tax ID Code and VAT No. 00856310628.

Contracting Parties:

The following are parties to the contract:

– Incas Caffè srl, with offices  in 82100 Benevento, at Pezzapiana Industrial Area, Tax ID Code and VAT No. 00856310628

– Client: the final consumer, that is, the person who acts for purposes that are not connected to his own business/professional activity, identified via the website www.incasscaffè.it or via phone call, who has placed an order accepted by Incas Caffè srl.

Subject of the Contract:

With this contract agreement, respectively, the Supplier sells and the Buyer purchases  remotely through computerized instruments the material tangible goods indicated and offered for sale on the website www.incascaffe.it

Procedures for the execution of the agreement – Application and modification of the  General Sales Conditions:

The agreement between the Supplier and the Buyer is entered into exclusively through the internet when the Buyer accesses the website www.incascaffe.it  in the e-commerce section, named “coffee store” and, after following the procedures indicated he/she  formalizes the request for purchase of the goods offered there.

By placing an order with any of the available modalities, the Client declares to have acknowledged all of the indications given during the purchasing procedure and to fully accept the General Sales Conditions. Incas Caffè srl reserves the right to change the General Sales Conditions giving notice of it in this page of its website. The applicable General Sales Conditions are those in force in the  moment the order is placed. Any change will be effective after publication on the website.

Website Registration

The Registration with username and password is optional. If the Client does not wish to register, he/she can still make a purchase: he/she will be required to enter the data that are necessary to the delivery and to the final invoicing of the order.

Products/Services Features and Prices

Featured images depicting the products might not be perfectly representative of their features, but they might differ in color, dimensions and depicted accessory products. All the support information to help the purchase are to be intended as general information material, not referable to the real features of a single product. The products are offered at the price specified in the website on the date of the order placement. The coffee products are withdrawn from sale 4 months before the best before date.   The prices shown are VAT included, and the VAT amount will be specified in detail in the invoice, where applicable. Prices are shown without shipping and delivery costs ; however, such costs are anyway indicated in the final section before placing the order and they are specified in the order receipt confirmation sent via mail to the Client

Order Placement

Orders can be placed only from and toward the following countries: Italy, Republic of St Marino, Vatican City. Orders from abroad will be dealt with off line by  Incas Caffè S.r.l.
Orders are subject to minimum and maximum quantity limitations and products are offered within the limits of stock availability.

Where existent, promotional codes  offered by Incas Caffè srl are valid only on products and for the period specified from time to time. Promotional codes are neither reimbursable nor cumulative.  In order to take advantage of any discounts and/or offers related to a promotional code, the code will have to be inserted in the given space upon order confirmation on the website. In case of forgetfulness, orders may not be cancelled or renewed in order to take into account the promotional code.  Orders placed by underage clients will not be accepted. The phases of an order placement and for the execution of the purchase agreement are clearly stated in the sequence of website pages through text and explanatory graphics. It is possible to correct any data input  mistakes before placing the order.

Order Receipt Confirmation and Order Confirmation.

Upon receiving an order, Incas Caffè Srl will automatically send a receipt confirmation via  mail containing a recap of all the data of the order.  Following the receipt of an order, Incas Caffè Srl will check the ordered product’s availability and only then it will accept the order and ship the product.  Should Incas Caffè Srl not be able to handle an order, the Client will be promptly informed.

The Client is not entitled to any  compensation , as well as any contractual or extra contractual  liability for direct or indirect damages to people and/or property deriving from the non-acceptance of an order.

Accepted Payment Methods

Incas Caffè srl accepts payment only via the systems specified below:

Credit Card (American Express, Visa o MasterCard);
PayPal: online payment system which allows any company or consumer owning an e-mail address to send and receive payments, upon registration. The payment takes place through the PayPal payment platform.

Products Shipment

Products can be shipped and delivered only within the territories of Italy, S.Marino and Vatican City.

Incas Caffè Srl  will ship the purchased products only to the destination specified in the order. P. O. boxes will not be accepted as delivery addresses.  .

Incas Caffè srl will ship the Client’s ordered products via courier to the delivery address specified by the Client approximately within 24 working hours of acceptance of the order.

The delivery will take place normally within 4 working days. The time indicated for delivery is approximate.

Delivery expenses are invoiced based on the fees specified on the website or communicated by Customer Service on the date in which the order was sent.

The goods recipient is responsible for the payment of taxes and custom duties provided for by the regulations applicable in the territory in which the products are shipped.

The courier is responsible for delivery.

Incas Caffè Srl commits to gather any possible missing or delayed delivery report via its Customer Service number 082424226 and, if appropriate, to help the Client protect his right as set out by law.

Acceptance of the products by the Client

Any damage to packaging and/or to the product, or a mismatch in the number of packages or of the directions  must be immediately notified by placing a specific indication on the delivery note. By signing the courier document, the Client attests the real external integrity of the product and the conformity of the delivery. Any possible problems relating to the real physical integrity, the conformity or the completeness of the products received must be notified within 10 working days from delivery by sending an e-mail to  commerciale@incascaffè.it , or by calling Customer Service at 0824 24226.

Invoicing

Invoices will be issued to any private Client who will insert his/her tax code , and for any order of Professional Clients or Companies with a VAT number.  In order to issue an invoice the information used will be those given by the Client upon placement of an order. No variations in the invoice will be possible after the invoice is issued. When placing an order, it is necessary to specify whether or not the shipment address is different than the invoicing address. If a private Client chooses not to insert his/her tax code, or a Professional Client or Company choose not to insert their VAT number, Incas Caffè Srl will not issue an invoice, nor it will certify payment through the issue of a sales receipt (art. 22, par. 1 PRD 633/72 and art. 2, let. OO) PRD 696/96

Right of Withdrawal and Return Terms and Conditions

As ruled by Lgs. D. 21 February 2014, no.21 for implementation of Dir. 2011/83/UE on Consumers’ Rights, the Client can return the purchased products and obtain a reimbursement of the price actually paid. The Right of Withdrawal can be exercised within 14 days from receiving the product following the modalities below:

1. Before the above mentioned term expires, the Client has to send Incas Caffè Srl a letter via registered post with acknowledgement of receipt, or else he/she will have to submit another explicit declaration in that respect. The communication can be sent, within the specified term, via telegram or e-mail to the address commerciale@incascaffè.it, or communicated by phone to Customer Service at 082424226;

2. Customer Service will contact the Client and will give him/her all the indications to carry out the return procedure.

3. The Client will then be contacted by the courier to agree on the collection of the return.

4. The return of the product will have to take place within the term of 14 days from the return confirmation date from Customer Service.

The reimbursement of the price paid for the purchase of the product does not include shipping costs relating to the return.

Should the value of the products suffer a decrease due to a different handling than the one that was necessary in order to establish the nature, the features  and the functioning of the products, ( to simplify: damaged products, not correctly packaged or incompletely packaged, or in case of missing and/or damaged parts, such as components, elements, accessories, packaging materials, boxes, documents and/or other items), Incas Caffè will reimburse the Client the purchasing price minus the value of the above mentioned decrease. Should the Client return the products after the term specified above or in case of products opened and/or partially used and that cannot be returned, the withdrawal right does not apply and Incas Caffè Srl will return the goods to the Customer and will charge him/her the shipping costs.  .

Taking into account the limitations mentioned above, Incas Caffè Srl will reimburse the price actually paid by the Client within 14 days of receiving the withdrawal communication, taking out the shipping expenses, via credit note on the Credit Card or on  the bank account, prior to the Client communicating  his/her IBAN code.

Warranty

All products other than food products, sold by Incas Caffè Srl are covered by the manufacturer conventional warranty and by the 24 months warranty for non-conformity defects as set out by Lgs. D. 24/2002 and f.m. and by articles 130 and  132 of  Lgs. D. 206/2005. In order to benefit of the warranty assistance, the Client will have to save the invoice, or, where existent, the delivery note.

Should the purchased product have any defects and/or should it be damaged during transport, the Client will be able to request replacement within a compulsory term of 10 days from receipt via telegram, or e-mail to the following address: commerciale@incascaffè.it  , or via phone communication to Customer Service at 082424226. The Client is obliged to return the defective or damaged product in its original packaging, which is to be whole in all of its parts.

In case of product replacement, the shipping expenses related to the return will be paid for by Incas Caffè Srl, which will provide for the replacement of the product with an identical one, or, in case of stock issues, with one of the same value.  .

Governing Law and Jurisdiction

The sale of products and /or services takes place in the Italian territory and is therefore subject to the Laws of the Republic of Italy.  The jurisdiction for the resolution of any disputes will be the one assigned according to the governing Italian Law at the moment the contract will be rescinded.
